Terms of Service
These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for using the services (hereinafter referred to as "Service") provided by hackjpn Inc. (hereinafter referred to as "Company") on this website. All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Application)
- These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
- In addition to these Terms, the Company may establish various rules and regulations (hereinafter referred to as "Individual Provisions") for the use of the Service. Regardless of their title, such Individual Provisions shall constitute a part of these Terms.
- In the event of any conflict between these Terms and the Individual Provisions, the Individual Provisions shall take precedence unless otherwise specified therein.
Article 2 (User Registration)
- Registration shall be completed when an applicant agrees to these Terms, applies for registration in the manner prescribed by the Company, and the Company approves such application.
- The Company may decline a registration application if the applicant falls under any of the following categories, and shall have no obligation to disclose the reasons:
- False information was provided in the registration application
- The application is from a person who has previously violated these Terms
- The Company otherwise deems the registration inappropriate
Article 3 (Management of User ID and Password)
- Users shall manage their User ID and password for the Service at their own responsibility.
- Users may not transfer, lend, or share their User ID and password with any third party under any circumstances. If a login is made with a matching combination of User ID and password, the Company shall deem it as use by the registered User.
- The Company shall not be liable for any damage caused by unauthorized use of a User ID and password by a third party, except in cases of intentional misconduct or gross negligence on the part of the Company.
Article 4 (Usage Fees and Payment)
- Users shall pay the usage fees displayed on this website, as separately determined by the Company, for paid portions of the Service, using the payment method designated by the Company.
- If a User fails to pay usage fees on time, the User shall pay a late payment penalty at an annual rate of 14.6%.
Article 5 (Prohibited Activities)
Users shall not engage in the following activities when using the Service:
- Activities that violate laws or public order and morals
- Activities related to criminal acts
- Activities that infringe upon copyrights, trademarks, or other intellectual property rights contained in the Service
- Activities that destroy or interfere with the servers or networks of the Company, other Users, or third parties
- Commercial use of information obtained through the Service
- Activities that may interfere with the operation of the Company's services
- Unauthorized access or attempts thereof
- Collecting or accumulating personal information about other Users
- Using the Service for fraudulent purposes
- Activities that cause disadvantage, damage, or discomfort to other Users or third parties
- Impersonating other Users
- Advertising, solicitation, or business activities on the Service without Company authorization
- Activities aimed at meeting strangers of the opposite sex
- Directly or indirectly providing benefits to anti-social forces in connection with the Company's services
- Any other activities deemed inappropriate by the Company
Article 6 (Suspension of Service)
- The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following reasons exist:
- Maintenance, inspection, or update of computer systems related to the Service
- The Service becomes difficult to provide due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- Computers or communication lines are stopped due to an accident
- The Company otherwise determines that provision of the Service is difficult
- The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.
Article 7 (Usage Restrictions and Deregistration)
- The Company may restrict the use of all or part of the Service or deregister the User without prior notice if the User falls under any of the following:
- Violation of any provision of these Terms
- Discovery of false information in registration details
- Failure to fulfill payment obligations
- No response to communication from the Company within a specified period
- No use of the Service for a specified period since last use
- The Company otherwise deems use of the Service inappropriate
- The Company shall not be liable for any damage caused to Users by actions taken under this article.
Article 8 (Withdrawal)
Users may withdraw from the Service by following the withdrawal procedures prescribed by the Company.
Article 9 (Disclaimer of Warranties and Limitation of Liability)
- The Company makes no express or implied warranties that the Service is free from defects in fact or in law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
- The Company shall not be liable for any damage arising from the Service to Users, except in cases of intentional misconduct or gross negligence by the Company. However, this disclaimer shall not apply if the contract between the Company and the User regarding the Service constitutes a consumer contract as defined by the Consumer Contract Act.
- Even in the cases described in the proviso of the preceding paragraph, the Company shall not be liable for damages arising from special circumstances due to negligence (excluding gross negligence) by the Company. Compensation for damages caused by the Company's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month the damage occurred.
- The Company shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties in connection with the Service.
Article 10 (Changes to Service Content)
The Company may change, add, or discontinue the content of the Service with prior notice to Users, and Users shall accept such changes.
Article 11 (Changes to Terms of Service)
- The Company may change these Terms without individual consent from Users in the following cases:
- When changes to these Terms serve the general interest of Users.
- When changes to these Terms are reasonable in light of the purpose of the Service agreement and the necessity, appropriateness, and other circumstances of the change.
- When changing these Terms, the Company shall notify Users in advance of the intent to change, the content of the revised Terms, and the effective date.
Article 12 (Handling of Personal Information)
The Company shall handle personal information obtained through the use of the Service appropriately in accordance with the Company's Privacy Policy.
Article 13 (Notices and Communications)
Notices or communications between Users and the Company shall be made by methods determined by the Company. Unless the User notifies the Company of a change in contact information in the prescribed manner, the Company shall deem the currently registered contact information valid and shall send notices or communications to such contact information, which shall be deemed to have reached the User upon dispatch.
Article 14 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or pledge their contractual position or any rights or obligations under these Terms to any third party without the prior written consent of the Company.
Article 15 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
